TERMS & CONDITIONS
By booking photography services with Rooftohearts, you confirm that you have carefully reviewed and agreed to the following Terms & Conditions.
Reservation & Retainer

Your session date is officially reserved only upon receipt of a non-refundable retainer.
The retainer:
secures your selected date,
covers preparation, planning, and exclusive time allocation,
is non-refundable and non-transferable under all circumstances.
Rescheduling

A one-time reschedule may be granted within 30 days of the original session date, strictly in cases of:
illness,
emergency,
unforeseen circumstances beyond reasonable control.
Rescheduling is subject to availability and requires timely notice.
No reschedules are guaranteed beyond this window.
Session Duration & Overtime & Late arrival

Sessions are scheduled for the time purchased.
Overtime is available at $400 per hour, billed in 30-minute increments.
Overtime must be approved during the session and settled prior to final gallery delivery.
Clients are granted a grace period of up to 15 minutes. Any arrival beyond this time will result in the session being shortened accordingly, as the session will still end at the originally scheduled time.
Late fees:
-15-30 min: $50
-30-60 min: $100
-60+ min: $150
If you miss the entire scheduled session time, it will be considered a no-show and the full session price will be charged.
Late arrival may also result in fewer photos/video, locations, or outfits due to the reduced shooting time.
Please plan ahead for traffic, parking, and walking time to the location.
If the client wishes to extend the session, additional time may be added subject to availability and will be billed as overtime.
Artistic Vision & Creative Authority

By booking, you acknowledge that:
you are familiar with my portfolio and artistic approach,
you trust my creative judgment, color grading, and visual storytelling,
final images will reflect my signature style.
Requests to alter artistic direction, color grading, or overall mood after delivery are considered additional services and billed separately.
Editing Philosophy

Included in all sessions:
professional color correction,
light skin retouching of temporary imperfections (minor blemishes, redness).
Not included:
body reshaping or slimming,
facial structure alteration,
digital makeup,
changes to permanent features.
Additional retouching or re-editing is available at $150 per hour.
Refunds

Due to the creative and bespoke nature of photography:
no refunds are issued once services have been rendered or images delivered.
dissatisfaction based on subjective preferences does not qualify for a refund.
Gallery Access & Expiration

Galleries are delivered via a private online link and remain active for the stated period.
Clients are responsible for downloading and backing up their images.
Expired galleries may be re-uploaded for $85, which includes 30 additional days of access.
RAW Files

RAW files are not included unless specified.
Optional RAW photo files purchase: $85.
Optional RAW video files purchase: $85.
RAW files are delivered unedited via online gallery.
Scope of Services

The photographer provides photography services only.
Any services beyond standard photography and editing are billed separately.
Agreement
Booking, submitting payment, or attending a session constitutes full acceptance of these Terms & Conditions.

Purchase digital products
All digital products are final sale and non-refundable. By purchasing, you agree that the product is for personal use only and may not be shared, reproduced, resold, or distributed. All content is protected by copyright and remains the intellectual property of Rooftophearts.

Portfolio & Social Media Use
By booking a session, the Client acknowledges that selected photographs and/or video may be considered for use in the Photographer’s professional portfolio, website and social media channels for the purpose of showcasing the Photographer’s work.
The Photographer will use only selected images that are representative of the Photographer’s style and services.

Full Confidentiality / NDA Add-On
Clients who require complete confidentiality may purchase a Full Confidentiality / NDA Add-On for an additional $500 + HST.
With this add-on, Rooftophearts agrees not to publicly use, publish, share, submit, display, or otherwise distribute any photographs or video created during the session for portfolio, website, social media, publications, competitions, vendor collaborations, sample galleries, educational materials, behind-the-scenes content, or other promotional purposes.
The confidentiality fee must be requested and paid before the session. Once purchased, the Photographer will treat all visual content from the session as confidential and will use it solely for the purpose of delivering the Client’s final gallery and/or video.
